[Alicia Hunt]: I'm Felicia Hunt. I'm the director of planning, development and sustainability for the city. And with me is Kyla, who is our graduate intern, who is organizing our annual Harvester Energy Festival. So the Harvester Energy Festival, we've been running for 16 years. And a couple of years ago, under Mayor Brianna suggested that we should actually have a beer garden at the festival, that that would help bring in more people who weren't normally coming to this event, which is a more environmentally energy oriented event. And so we did that a couple, we started a couple of years ago. And so I think this is actually the third year that we've come asking for a license to serve alcohol. And we have the last two years, we actually had a Medford business who did it. And they told us that it's not a, it's not enough of a revenue for them and they did not have the bandwidth and none of our Medford resident businesses were interested in sending over people to staff and alcohol table at our event. Um, so we did actually find, um, another organization that does this. And actually, Kyla, do you want to explain? And I believe Jean is on, this is Jean from black carpet. Kyla, do you want to just. introduce Jean.
[SPEAKER_10]: Yeah, yes. Hi, Jean. Nice to see you. I met Jean through a... What it is that they do. Oh, gotcha. Cool. Yes, Jean does a lot of like events with other cities and stuff like that. And Jean, you can speak more if you want, but they do like some farmers markets with Quincy. So they have some experience with working with municipalities. But other than that, they do events from anywhere between birthday parties to weddings and festivals, such as this one. And so they have a small vehicle that they operate out of, which is included in the application packet you saw. And yeah, China, if you want to bounce off of that and explain a little more, you're welcome to.
[SPEAKER_08]: So my name is Jean Barry. I own the Black Harp. We're a mobile Irish pub and bartending service. We do private events, public events. Some of the, I apologize, I'm on my phone because my laptop is a little crazy today. We do have experience in larger events. We've done the Run of the Charles, which is the clean-up non-profit for the Charles River in Boston. So we've done that event. We are the bar service for the Central Mass Irish Festival. out in Winchingdon, so that's a really large event that we've done. We've, as Kyla mentioned, we've worked with the City of Quincy before for their Roads to Rivers event, so we do have experience in those larger events. We've done the Celtic Festival that we just did in Milford, Mass., a couple of months ago. That was rather large, so we are experienced in that. I have over 40 years in the restaurant industry, 30 of it in the bar industry. All of my staff are also very experienced. I don't have anyone working for me with less than 10 years experience. And I used to teach the tips course for Massachusetts. So I'm very well versed in proper service.
[Robert Delafano]: Very good. I thank you for that dissertation. We really appreciate it. And I'm glad you addressed it because, you know, I'm a big, of keeping everything local. And I get that you reached out. I know who you reached out to, because everybody reaches out to them. But I thank you for thinking of our local methods first. And if they can't, then we have to go out and look elsewhere.
[SPEAKER_02]: So I thank you for that. Because I was curious about it. I see Holliston.
[Alicia Hunt]: It's like, how did that happen? The Harvest Energy Festival is a little slow for alcohol, because that's not really what people are thinking about. Um, and so, yeah, we had, um, deep cuts last year. Um, we've talked, I see Nick on the line, but we've talked with Max in the past, not signing. Um, but because this is located at a school and while we are technically on city property, the alcohol is not on school property. Um, it, he's always been a little uncomfortable for him to be hosting an event there at right next to the school. Sure. And I think the timing didn't work for them as well. And I feel like we reached out to one or two other places as well. I think we also yeah so and we, we did try that. And our to food vendors, which is not relevant to you, but actually callings will be back here and we're going to have our new Mexican place in Medford square. So they're actually coming and they don't have a truck or anything, but they'll be setting up tables to do food. And it's a good way for us to showcase some local Medford food. And I'm putting the word out there. If anybody next year wants to do the alcohol, please let me know. We think we talked to everybody who might possibly be interested, but yeah.

[Robert Delafano]: Just a quick story, and I know it's got nothing to do with it. I was eating at one of the local restaurants with my wife not too long ago. And I happened to order a Guinness draft with my dinner. And they had a machine that etched a polar bear into the top of the pint. Yeah. I said, wow, that's really cool. And when everybody saw it, Like, everybody started the water and, you know, on the, on the 12 different glasses again, and they said we could put anything on it, you know, that you want, but it was a cold night and they had a polar bear with a scarf or something. But anyway, everything looks good to me too. Gary. The only thing I didn't see was the insurance. Yes, that was the last thing they were sending me. Okay so yeah the insurance was sent over. I'm good with it.
[Alicia Hunt]: I just have one question because over the years we've heard sort of different things about demarcation of where alcohol can be and all and we do not want alcohol on the playground or in that area. We don't want food and alcohol over there but we weren't clear if we have to have it roped off with yellow tape, alcohol in here? Do we need signs? Could it be the whole grassy area where we would have other tables as well? I just wanted to be with what's comfortable with you all without sort of being so restrictive that people, well, I have to finish my beer before I can go look at another table. And then, well, maybe I won't have the beer. I want to hit that balance.
[Robert Delafano]: Chairman will tell you, you don't have to put a fence, but you should put some kind of markers there and then point out to individuals that we shouldn't go beyond this point. And we've seen it done with the simplest cones, right? The orange cones. You can do those, or you can do with, I believe Nick does them, like the, when people are running for office. The yard signs? Yeah, just stick them in, just no alcohol beyond this point. Okay. And just put it like around the perimeter area, because I notice where you've got the red, that's where it's going to be, I guess, for the, Right.
[Alicia Hunt]: And I would say that we will have tables all the way to this corner.
[Unidentified]: Yeah.
[Alicia Hunt]: And so to allow them to be, you know, through the end of the tables is okay, but we will absolutely not allow people like we'd have signs, no alcohol on the playground. It's just, it's not good for the playground and be designed and built that playground.
[Robert Delafano]: What I would do is put them like along this border, along the parking lot. Cause you don't want people obviously going into the parking lot with the right. and just continue it around next to the playground. No alcohol beyond this point. So I mean, if a family wants to stand there and they watch the kids play in the playground, they can, but they're not going to be bringing it in. In all of this whole area, if it's wide open, I mean, you know, kids want to be playing wiffle ball or whatever with the family and stuff on the grass. That's cool.
[Alicia Hunt]: OK, great. And actually, the parking lot will mostly be electronics drop off. Okay. And recycling drop off. So it's not where people are parked anyhow. So it'll, they're, they would not be motivated to walk in there. It'll be an active drive area.
[Robert Delafano]: Plenty of those signs.
[Alicia Hunt]: Just say no alcohol. Thank you. It's really helpful to understand because there was somebody tried to tell me once that I needed to put up like riot fencing. I was like, really, is that necessary? Okay.

There's no trouble reporting nothing. And so we'd like to continue to do the same thing. And that's it. I know you have questions.

[Nick Bolitho]: Well, so where do we start? We basically expanded what we're doing from simply brewing beer. We decided that we wanted to basically make cider as well. And actually Ralph from the ABCC mentioned before to us that we should probably apply for the distilling permit as well whilst doing that at the same time. So we now have our state and federal distillery permit and our winery permit. The winery permit is specifically really more for making cider ourselves, although we'll probably subcontract out and find a partner to make actually wine as well. And probably the same thing on distilling as well where we'll probably do a small amount of distilling ourselves. Really main plan for that is going to be sort of adding to beers and creating some pre-mixed drinks. And what we're applying for is the 19H pouring permit so we can serve or sell our samples to people within the taproom for the brewery, the distillery and the winery.
[Robert Delafano]: You're expanding your horizons a little bit, which is good. Yeah.
[Daria Tejera]: Nick, were you changing the location too?
[Nick Bolitho]: Are you not changing the location?
[Daria Tejera]: No, same location.
[Nick Bolitho]: Yeah, because technically we're not allowed to sell samples in the, well, without the 19H, we have to have a separate location to sell the samples, but the 19H, I believe, is the commingling pouring permit. So we can then serve all products at the same spot.
[Robert Delafano]: Okay, are you going to be growing everything there or are you going to be brewing like your beer and distilled on a different location?
[Nick Bolitho]: So yeah, so we're going to do a small amount of distilling in the location and then we will be making, because we also have an alternating premises permit as part of our winery, so we will actually be making cider on site as well. And then we said we'll do a small amount of distilling. We'll make basically hard cider. And then we'll probably, so we'll actually be just subcontracting out for wine using our recipes because I'm not very good at making wine. At least you admit it.
[Robert Delafano]: Okay. I mean, that all sounds okay. Yeah. And the alteration of premise, that's just a little further down the road type of thing. Once you start doing that, after you've got the approval for the 19H, basically.
[Nick Bolitho]: Yes, I think I think I think I'm not fully sure what I believe said with the 19 inch. So we've, I think we've filed it.
[Robert Delafano]: Oh, yeah, you did that. I'm sorry.
[Daria Tejera]: Yeah, I was thinking change of location, but I'm an alteration.

[Nick Bolitho]: 2500 square feet. Is that what I read? So we're not, yeah, we're not actually, we're not adding any actual space. All it is, it's just to basically, so we can, I suppose, technically sell our samples in the same space that people are currently using for the brewery for drinking.
[Robert Delafano]: So that's what the state wants you to do, basically, is what you're saying?
[Nick Bolitho]: Yes. It's basically so you can basically serve all three lines from the same spot.
[Robert Delafano]: Okay, perfect. Alrighty. And the only thing I didn't see, I'm sure you didn't see it either, Alan, was about his notifications, but I spoke with Daria. She said she received them, so we're good with that. Okay, good. And the other thing, just when I was looking at everything, What you might wanna be aware of is sometimes the ABCC will want to see the cost of alterations in your bank account balances and stuff like that. May not need to in this case because of the circumstances, but just have any type of money spent on the alteration accounted for when the ABCC comes down to do an inspection, you'll have it. And then you won't run into any problems
[Nick Bolitho]: Yeah, yeah, we have we have cash reserves, which are more than cover the any alteration, although there actually isn't any.

[Robert Delafano]: Okay, very good. At this time, I'm going to call Sergeant Smith to read the report and kind of give us a description of why we're here today.
[Patrick Smith]: So sometimes I do a reading, sometimes I do a summary. I think there's a lot of key points in this. So I just, I'm going to go with a little bit of both there.
[Robert Delafano]: When we all have a coffee every now and then, we have to talk to each other. W, Phil, Liz, and us, just everywhere we're on, you know, Zoom or whatever, that's totally up to you.
[Patrick Smith]: Perfect. So this incident took place on Wednesday, June 24th, 2026 at approximately 10.48 PM. A member of the Great American Vietnam Security Team dialed 911 for an intoxicated female that was vomiting in a woman's restroom. Medford Fire, Medford Police, and Battaglia WMS responded to the scene. The Ponderosa and Medford Police officers learned a member of the security team, later identified as Christopher Deegan, located an intoxicated female covered in vomit inside the woman's restroom. Officer's located the female and she was subsequently identified herself as Ms. Arisha, I think that's how you pronounce it, Bassnett. Ms. Bassnett needed assistance from a female friend to stand and walk and showed visible signs of being intoxicated. Ms. Bassnett stated to officers that she was 21 years of age and did not consume any alcoholic beverages. She then changed her story and stated an unknown male purchased her a couple of alcoholic beverages. Ms. Bassnett denied purchasing any alcoholic beverages on her own. Miss Bassnett denied having an ID on her person. Officers were later learned that Miss Bassnett was in fact 19 years of age after she provided her date of birth. This was later confirmed by us and our systems. She would subsequently be transported via ambulance to CHA Everett due to a level of intoxication. Officers spoke with Mr. Deegan and learned that it was a family event that evening and IDs were not checked at the door. It was up to the bartender to ID before selling the beverages. So that was essentially opposite Tess Morrow's report. That's what was sent in to me. This was my followup. On Tuesday, June 30th, I spoke with Ms. Bassnett via telephone and learned the following. Ms. Bassnett arrived at the Great American Beer Hall approximately 7.15 p.m. Prior to arrival, she stated she did not consume any alcoholic beverages. At no point during the night did she have to produce an ID. According to Ms. Bassnett, she approached the bar with a new friend This friend ordered alcoholic mixed beverages. After making the drinks, the bartender placed the alcoholic beverages on the bar. Ms. Bassnett was able to pick up the mixed alcoholic beverages off the bar and walk away carrying the beverages. Ms. Bassnett explained that she consumed two alcoholic beverages that evening at Great American Beer Hall. After speaking with Ms. Bassnett, I contacted the owner of the Great American Beer Hall, Mr. Zaffer, explaining that I was investigating an incident involving an intoxicated 19-year-old female that was subsequently transported to the hospital on June 24th. Mr. Zaffer explained he was familiar with the incident and provided the following information. On the night of June 24th, a private event was held at the Great American Beer Hall. ID's were not checked at the door and the individual bartenders were responsible for checking. Mr. Zaffer was not present for the incident and learned of the incident the following day. After learning of the incident, the Great American Air Hall changed their internal policies. Risk bands would now be utilized for individuals under the age of 21. Effective immediately, the premises would only admit individuals over the age of 21 after 7 p.m. Security staffing would be increased from five to seven offices for larger events and police details would be requested. I'm familiar with the camera system at the Great American Bear Hall and I know that it only records for seven days, but you can keep the video for seven days. When I spoke to Mr. Zaffi, he was traveling to Cape Cod and stated that he reviewed the camera system before the videos were deleted. I specifically stated that I was interested to see if Ms. Bassnet was able to obtain an alcoholic beverage from the bar. I contacted Mr. Zaffer on July 15th to follow up with a possible video. According to Mr. Zaffer, he viewed the security video and did not observe an asbestos in the area of the bar. This was a mistake on my part. This is an investigator that I should have asked you to send a video of her consuming the beverage and where she had gotten the beverage initially. That's on me. I should have done that. Going forward, I'll make those changes. Yeah, that was going to be one of my questions. That was an investigative. Yeah, that's fine. So this is this is the conclusion to the whole night. After reading off tomorrow's report, reviewing MPD body camera footage and speaking with Ms. Bassanet and Mr. Zafir, I concluded the following. On Wednesday, June 24, 2026, Ms. Bassanet traveled to the Great American Theater Hall. I observed on responding officers' body cameras The premise to be packed with patrons watching the World Cup soccer game. According to Mr. Zaffer, IDs were not checked at the door, and the individual bartenders were responsible for checking IDs. Ms. Bassnett explained her ID was never checked or asked for. Ms. Bassnett was able to consume alcoholic beverages on the premise, even though she's in fact 19. Ms. Dasnett was intoxicated when officers arrived and vomited on herself. She was transported to the hospital. I spoke to Ms. Dasnett six days after the incident. I explained that I would not be pursuing any legal action against her but I asked for the truth on the night's events. This provided Ms. Dasnett no reason to lie to me. when she stated her friend ordered the alcoholic beverages at the bar and was able to pick up and walk away with the beverages. However, Mr. Zapler explained he reviewed the CCTV footage and stated Ms. Bassnet was not in the area of the bar. Based on the totality of the circumstance, I feel there is probable cause of violation of Massachusetts General Law, Chapter 138, Section 34, selling or delivering an alcoholic beverage to persons under the age of 21 occurred that evening. I am not discounting Ms. Bassnett's norm as a disaffected offense, but I'll personally view in the CCTV footage, I can only document their statements. Going forward, I will formally request that the video and its entirety be on set of investigation. So I came to that conclusion based on Everything I saw in the responding officers, body camera videos, I saw that it was packed. I saw the female who's clearly intoxicated in the bathroom covered in vomit. She's 19. She initially lied to officers. When I spoke to her six days later, she said that she was at that box. She said she was able to pick it up after the box and to put it down on the box. I told her there was going to be no criminal charges. There's no reason to lie to me at that point, in my opinion. But Mrs. Abbott said he looked at the video and he said that she was not in the area of the bar. I think that it is still a possibility that she was in the area of the bar. I know that we've reviewed the camera footage in the past and it's difficult to see, but that investigative side of it is on me. I should have requested a video of her consuming the beverage and where that beverage transpired to see if it was a direct link. It may not have been. facts of a 19-year-old was intoxicated on the premise and vomited on herself.
[Robert Delafano]: Okay. Thank you for the statement. Brian, do you have the opportunity to speak at this point?
[Zac Bears]: Yeah. I mean, this really started, uh, it was the Friday before we had a, um, USA, um, fundraising family event for the USA game. Someone in there asked us to do the same thing for, for the Mexican thing. We did it. Um, this happened, I can say with maybe 99, nine 10s, Sherry led, she did not get the drink, pick it up at the bar and walk back. A male friend was bringing her drinks when she was at the table. Um, My staff didn't wait to try and cover it up or anything like that. Once we were alerted that there was a problem, we called 911 right away. We didn't try to hide anything. And I wasn't waiting for Officer Smith or this meeting to change anything either. We knew that these parties were going to get bigger and bigger as they went. And so we changed up everything. From that, we had a meeting that next morning and we said, all right, we're going to be 21 plus after seven o'clock. Anyone that is over 21 needs to get ID by the bouncers. We brought in more security. We brought in police details. We changed our entire operation based on this one night and this unfortunate incident, but it did happen.
[Robert Delafano]: Yeah, it did get pretty crowded over there.
[Patrick Smith]: I did have one question. Sure. I really appreciate that the security call right away. Yeah, I mean, that makes a difference every time. I really appreciate that. I did have one question about the risk ends. I may have heard it wrong. Are you putting risk ends on people that are over 21 or under 21? Over 21. Over 21. Yeah, it was written. Yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah.
[Robert Delafano]: I think at the beginning, didn't you used to stamp your hand or something when you first opened? Yeah. Then we had people buying the stamps. So yeah.
[Zac Bears]: Yeah. I remember I had gone in there. Yeah. Yeah. After you were open and I got a stamp or something. The hard part is being family friendly and 21 plus when those are, these are going on. So.
[Robert Delafano]: Brian, was any disability action on the bartender? Did you let him go or is he still?
[Zac Bears]: that individual still employed by you guys? She's still employed with us. I didn't think it was her fault that her friend was bringing drinks back to the table that she was sitting at.
[Robert Delafano]: So, I don't know. I'm sorry. It said a private party, is there a separate entrance that allows individuals to enter during a private party?
[Zac Bears]: No, it's all the same entrance. This was just, it was a World Cup watch party for Team Mexico. Um, again, it started, so the Team USA, we had one for Team USA. Someone there said, Oh, can I do something somewhere? Yeah, no problem. Um, it's all, it was all through the same entrance. And so there were more on the books after this and we canceled all these fundraising, family friendly stuff for the World Cup.
[Daria Tejera]: So. Can I just add one thing? Sure. So as Dean was saying, if the bartender knows that you're ordering more than one drink, right? Me too, yes. She should be asking. I'm doing this for, yeah. Yeah, only because I know, I've seen people do this, right? Just because then you're covering your own. Yep. Anyway, you purchase alcohol. If one person is a minor, they won't let you leave with the alcohol.
[Robert Delafano]: Yeah, so. Yeah, I mean, that's how. Let me ask you a question is how. Sophisticated is your surveillance system like if in this particular I know it's too late to look at it because it's past the seven days, but say. Sergeant Smith come to you and said, OK, the boyfriend was purchasing the alcohol and you said that. the young lady wasn't with him picking the drink up off the bar. Is your surveillance system good enough that you can look at other cameras watching him walk to the table with that drink and see who he's with and actually putting it down in front of that person?
[Zac Bears]: It depends on where you are in the building. So we do have blind spots, but in this particular case, yeah, I could see who it was.
[Robert Delafano]: I mean, something like that would be helpful. I mean, obviously, if you had gone there and, I mean, you would have looked at the surveillance and saw that the young lady was not at the virus, as Mr. Zapdar explained, and then you could have said, okay, let's follow him over to the table and see what's going on. And now, does this put them responsible, or does this put it on, The, you know, I mean, as a person under 21 consuming an alcoholic beverage in there, but on the other hand, it's like the wristbands, great idea. The person don't have a wristband and they're drinking an alcoholic beverage. It's easy for your security to spot it. And that's basically what I'm sure they look for. But once the people were in, in their 21 plus, uh, they get by security or they get by, uh, whatever, uh, prior it's, it's kind of like, it's too late at that point. So, you know, once you're making sure everybody's 21, when they go in, there's not an issue, but the wristbands, uh, just to have your staff really pay a little closer attention to anybody drinking an alcoholic beverage without a wristband.
[Zac Bears]: Yeah. Like I said, we changed everything. Like, and a couple of what we haven't had. You know, we didn't have anything the rest of the World Cup, but we had really large crowds. I was actually really happy with the way that we changed and the way that we operated for the rest of the World Cup, the rest of the summer.
[Robert Delafano]: Yeah. And I would imagine it wasn't there for any of those games, but I would imagine it was. I drove by a couple of them and I could barely get down to Mystic Avenue and Hancock. I mean, that's how many people were there. And one morning I just chuckled. It was after, the night I drove by that there was actually a trail, a tractor trail loader from Burke District, someone that was delivering beer. And so, with the amount of people they must have had in there, they must have ran out of beer. It was crazy. So it's, I mean, in my opinion, you did the right thing to prevent foreseeable harm because you had security call 911 for the young lady that had the vomit all over herself. again, it just keeps coming back to this surveillance thing. It's that's that's the thing that's, you know, gets me a little bit and until we can kind of refine it.
[Patrick Smith]: I do take responsibility for this. We run into that seven day window here. So this happens on the 24th. I don't get it from Lieutenant Larkowitz and till probably two days later when I'm back to work, because I work opposite schedules. And then I contacted him. I waited that four days till the 30th till I reached out to him. That video was getting deleted the next day. He was driving to Cape Cod. Yeah, exactly. And it's on his phone. That's my understanding. Yeah, phone and computer. You know, I take responsibility for not getting the video footage. I can only base it off the statements that I obtained from both Mrs. Abner and the 19-year-old.
[Zac Bears]: I didn't wait to like look or change or any of that. I heard about it the next day. We met, we reviewed everything and said, how do we... Yeah, I think the changes are good.
[Patrick Smith]: Yeah, changes are always good. Wristbands, arms, more security. I mean, that prevents these things from happening.
[Robert Delafano]: I mean, it's such a massive place, it's almost impossible to watch everybody. And, you know, taking, you know, the responsibility to change things was great. It would really make our lives and your life probably a little easier if you could get a little bit of hard drive on that thing to record more than seven days. [Patrick Smith]: And then if things, I mean, that's, for this incident, we're talking the 4th of July weekend, right before, so I find out, and then I come in, and I'm right back. Yeah, you're already four or five days, you know, a little behind.

It did take his team a little time to investigate too with the person that would, you know, you're going to have to have the people there that were there that night. knowing the person that you're talking about, and then you're going to have to have the bartenders in your, I guess your IT guy, do the following. Okay, yeah, she wasn't enough, but this guy, this is the guy that was with her. You know, you got to kind of look back at a few videos and look forward to a few videos. That place was packed. It was packed. I don't see how the fire department's not there on nights like that, because they're obviously way out of their capacity.
[Patrick Smith]: But for some, the way I look at this, it's based on the probable cause standard. So it's more likely than not based on the facts and circumstances. So that's how I made my determination. I'm not discounting either one of them, but it puts it out for me.
[Robert Delafano]: Unfortunately, unless it's witness, I understand. Yeah. It's really not much we can do, but I just wanted to put the bug in his ear about the surveillance to make sure that from this point forward, which I believe we had that in the last, the last few issues.
